Terms & Conditions of Use

These Terms and Conditions of Use ("Terms") govern the use of the FaceLive application, developed by the Sam&Felix team on behalf of Lowegate.

2.1 Age requirements

• The application is intended for users aged 16 or older.
• Users under 18 must obtain consent from a parent or legal guardian.
• Access is forbidden for users under 16.

2.2 Account registration

• Registration is free and voluntary.
• You must provide truthful information and keep it up to date.
• Each user may hold only one account.
• Sharing access credentials is forbidden.
• You are responsible for the security of your account and for any activity carried out through it.

FaceLive is a web application offering:

• Video logging: recording videos with geographic metadata.
• Geolocation: real-time mapping of users.
• Content sharing: uploading and viewing videos and images.
• Social features: interaction between users on the map.
• Live streaming: real-time video broadcasting.

3.1 Service "as is"

The service is provided "as is", with no guarantee of:

• 24/7 continuous availability.
• Absence of bugs or errors.
• Compatibility with every device.
• Guaranteed loading speed.
• Permanent retention of data.

4.1 Permitted use

• Personal, non-commercial use of the application.
• Publishing original content or content for which you hold the rights.
• Respecting the privacy of third parties.
• Respectful interaction with other users.

4.2 Prohibited use

The following are strictly forbidden:

• Illegal content: uploading material that breaches local or international law.
• Privacy violations: recording people without their consent.
• Cyberbullying: harassment, threats or intimidation.
• Spam: mass-sending of unsolicited content.
• Hacking/exploits: any attempt to breach the security of the application.
• Multiple or fake accounts.
• Reverse engineering: unauthorised decompilation or analysis of the code.
• Unauthorised commercial use of the service.
• Inappropriate content: pornography, violence, hate speech.
• Stalking: using geolocation to harass others.

4.3 Content responsibility

• You are solely responsible for the content you upload.
• You must hold all rights to the content you publish.
• You must respect copyright, trademarks and third-party rights.
• You are liable for any legal violations.

6.2 Exclusion of indirect damages

Under no circumstance shall we be liable for:

• Consequential or indirect damages.
• Loss of profits or opportunities.
• Moral or reputational damages.
• Costs of replacement goods or services.

6.3 Indemnification

You agree to:

• Indemnify Sam&Felix and Lowegate against any claim for compensation.
• Hold harmless from legal costs arising from use of the app.
• Compensate any damage caused to third parties.
• Defend in case of legal action initiated by third parties.

8.1 Rights over the application

• The FaceLive application is owned by Lowegate.
• The code is developed by Sam&Felix.
• All rights are reserved.
• Unauthorised copying or reproduction is forbidden.

8.2 User content

• Users retain ownership of their content.
• They grant Lowegate a non-exclusive, royalty-free, worldwide licence to host and display such content within the service.
• Removal can be requested at any time.

8.3 Third-party content

• Uploading copyrighted content without authorisation is forbidden.
• You must hold the rights to any background music used.
• Respect the image rights of people filmed.
• Do not use registered trademarks without permission.

9.1 Account suspension

An account may be suspended for:

• Breach of these Terms.
• Inappropriate behaviour.
• Justified reports from other users.
• Suspicious or fraudulent activity.

9.2 Service termination

• Lowegate may terminate the service at any time.
• No prior notice of closure is guaranteed.
• Data may not be recoverable.
• No refund is due as the service is free of charge.

9.3 Effects of termination

• Immediate loss of access.
• Possible deletion of content.
• Loss of social connections on the platform.
• Prohibition on creating a new account.

10.1 Google AdSense

• The app uses Google AdSense to display ads.
• Ads are managed automatically by Google.
• Advertising revenue belongs to Lowegate.
• Users are not entitled to any share of advertising revenue.

10.2 Sponsored content

• Lowegate may include promotional content.
• The absence of ads is not guaranteed.
• Users may not remove advertising.
• No premium subscription is currently available.

11.1 Right to amend

• Lowegate may amend these Terms at any time.
• Changes are effective from publication.
• Continued use of the app implies acceptance of the changes.

11.2 Notification of changes

• Changes will be published on this page.
• The update date is always shown at the top.
• Material changes will be notified in-app or by email.

12.1 Jurisdiction

• These Terms are governed by Italian law.
• The Italian Consumer Code applies.
• The GDPR applies for personal-data protection.

12.2 Dispute resolution

• Competent court: Munich (Germany).
• Mandatory mediation attempt before litigation.
• Possibility of arbitration for minor disputes.

13.1 Technical support

• Support is provided on a "best effort" basis.
• No guaranteed response time.
• Please consult FAQs and self-service documentation when available.

14.1 Severability

If any part of these Terms is held invalid, the remainder shall remain in force.

14.2 Waiver

Failure to enforce any clause does not constitute a waiver of the rights deriving from it.

14.3 Entire agreement

These Terms, together with the Privacy Policy and the Disclaimer, constitute the entire agreement between the parties regarding the use of the service.

By using the application, you declare that you:

• Have read and fully understood these Terms.
• Accept all risks and limitations of liability.
• Are of legal age, or have parental/guardian consent.
• Use the app in compliance with applicable laws.
• Take full responsibility for your actions and content.
