1. Acceptance of Terms

By accessing and using OrionEye ("the Platform"), accessible at https://facelive.net/orioneye/, you agree to be bound by these Terms of Service. If you do not agree, you must discontinue use immediately.

2. Description of Service

OrionEye v4.0 is a cyber intelligence, geospatial analysis, and space technology platform developed by Samuel La Manna. It provides:

  • Interactive geospatial mapping with multiple intelligence overlays
  • Open-Source Intelligence (OSINT) research tools
  • Real-time data aggregation from public APIs (aircraft, weather, conflicts, news, etc.)
  • AI-powered analysis via Google Gemini integration
  • Space technology monitoring (satellites, ISS, launches)
  • Console-based command interface for advanced queries

The Platform is provided free of charge for educational, research, and professional intelligence purposes.

3. Acceptable Use

You agree to use OrionEye only for lawful purposes. Specifically, you shall NOT:

  • Use the Platform to harass, stalk, threaten, or harm any individual
  • Attempt to identify, locate, or track private individuals without legal authorization
  • Use OSINT tools to violate the privacy, dignity, or rights of any person
  • Systematically scrape, crawl, or extract data beyond normal interactive use
  • Attempt to bypass security controls, rate limits, or access restrictions
  • Use the Platform for illegal surveillance, unauthorized intelligence gathering, or law enforcement activities without proper jurisdiction
  • Redistribute or commercially resell data obtained through the Platform
  • Impersonate OrionEye, its developer, or any official entity

Important: OrionEye processes exclusively publicly available data from open sources. The user bears full responsibility for how they use the information obtained through the Platform.

4. OSINT & Intelligence Disclaimer

OrionEye is an Open-Source Intelligence (OSINT) aggregation tool. All data displayed by the Platform is sourced from publicly accessible databases, APIs, and open datasets. OrionEye:

  • Does NOT perform facial recognition or biometric analysis
  • Does NOT access private databases, classified systems, or restricted networks
  • Does NOT create deepfakes, synthetic media, or manipulated content
  • Does NOT intercept communications or conduct active surveillance
  • Does NOT provide access to non-public personal data

All intelligence data is aggregated from legitimate, open, and publicly documented sources including government APIs, academic datasets, and licensed commercial data feeds.

5. Data Accuracy & Limitations

OrionEye aggregates data from multiple third-party sources. While we strive for accuracy:

  • We do not guarantee the accuracy, completeness, or timeliness of any data
  • Real-time data (aircraft, satellites, weather) may be delayed or incomplete
  • AI-generated analysis (Gemini) is advisory and may contain errors
  • Conflict and geopolitical data reflects reported events, not verified ground truth

Users should independently verify critical information before making decisions based on Platform data.

6. Intellectual Property

OrionEye, including its source code, interface design, visual identity, and original content, is the intellectual property of Samuel La Manna.

  • The OrionEye name, logo, and visual branding are proprietary
  • Third-party data displayed through the Platform remains the property of its respective providers
  • Users may not copy, modify, distribute, or create derivative works of the Platform without written permission

7. Third-Party Services

OrionEye integrates multiple third-party APIs and services. These services have their own terms of use and privacy policies. By using OrionEye, you also agree to comply with the terms of:

  • Google Maps Platform Terms of Service
  • Google Gemini API Terms of Service
  • OpenChargeMap Terms of Use
  • OpenSky Network Terms of Use
  • ACLED Terms of Use and Attribution Policy
  • GDELT Project Terms of Use
  • NASA Open Data Policy

OrionEye is not responsible for the availability, accuracy, or policies of third-party services.

8. Availability & Service Continuity

OrionEye is provided on an "as is" and "as available" basis. We do not guarantee:

  • Uninterrupted or error-free operation
  • Availability of any specific feature or data source
  • Specific response times or performance levels

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Samuel La Manna and OrionEye shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not liable for decisions made based on data or analysis provided by the Platform
  • Total liability, if any, shall not exceed the amount paid by the user for the service (which is zero, as the service is free)

10. Termination

We reserve the right to restrict or terminate access to the Platform for any user who violates these Terms, without prior notice. Upon termination, all provisions that by their nature should survive will remain in effect.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the Republic of Italy. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Italy.

12. Changes to Terms

We may revise these Terms at any time. The "Last updated" date at the top indicates the latest revision. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
